Some employment rights are only activated after certain periods of continuous
employment (called qualifying periods), for example the right to
bring a claim of unfair dismissal or the right to a redundancy
payment. The length of continuous employment is also used to
calculate the amount of statutory
awards, such as a redundancy payment.
The basic rule is
that there is continuity of employment from the start of employment
until that particular employment ends. Breaks in the contract of
employment with the same employer or changing employment will break
continuity except in certain circumstances.
