Employment Memo

CHAPTER 31  Transfer of the business

Many types of transfers, such as the sale of a business or the contracting out of a service, may be covered by UK transfer regulations.
The general purpose of such regulations is to safeguard employees' rights when the business in which they work changes hands. Where the regulations apply, their effect is that most rights and liabilities transfer automatically from the transferor to the transferee. Transfer-related changes to terms and conditions of employment may be void and dismissals in connection with the transfer may be automatically unfair. Both transferor and transferee are also subject to specific information and consultation obligations.
