Prosecutions under health and safety and fire safety legislation can be brought by the relevant enforcement authority in either a magistrates' court or the Crown Court (s 33 HSWA 1974 ; art 32 SI
2005/1541 ). The maximum penalties for the majority of offences are as follows (Health and Safety (Offences) Act 2008 ; s 85 Legal Aid, Sentencing and Punishment of Offenders Act 2012 ): -
magistrates' court: unlimited fine and/or 6 months' imprisonment; and - Crown Court: unlimited fine and/or 2 years' imprisonment....
