Implementing a redundancy programme

  • First establish that there is a genuine redundancy situation (i.e. a closure of the business, a closure of the place of work or a reduced requirement for employees to carry out work of a particular kind).
  • Be aware that if 20 or more redundancies are proposed at one establishment within a 90-day period, statutory collective consultation obligations will apply, in addition to individual consultation requirements (these are not discussed in this checklist). It will also be necessary to notify the Secretary of State of the proposed redundancies on Form HR1 (take legal advice on how to complete the Form HR1 if you have employees based at various locations in light of current case law).
