Changing contracts of employment

  • First, check whether the proposed change relates to an express or implied term of the employee’s contract of employment or whether it relates to a provision, rule, policy or benefit which might be regarded as having contractual effect.
  • If the proposed change does not affect a contractual term, it can be implemented without the employee’s consent. However, the change must still be made without breaching your implied obligation of trust and confidence. Therefore, consider consulting with the employee about the change before implementing it.
